Welcome to Dermify. These Terms & Conditions apply to your use of our website and to all orders placed through our online store.

The terms “we”, “us” and “our” refer to Dermify. Dermify operates this website and online store, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience.

Dermify is powered by Shopify, which enables us to provide our online store and related services.

By accessing our website, interacting with our online store or purchasing from Dermify, you agree to these Terms & Conditions and our Privacy Policy. Please read them carefully before placing an order. If you do not agree to these Terms & Conditions, you should not use or access our website.

2. Use of Our Website

You agree to use the Dermify website for lawful purposes only.

You must not misuse our website, interfere with its security, copy or extract content without permission, upload harmful material, or use the website in a way that may damage Dermify, our customers, Shopify, or our services.

You must not use our website to:

Violate any law or regulation
Infringe the intellectual property rights of Dermify or any third party
Transmit false, misleading, harmful, abusive, defamatory or unlawful material
Upload or transmit viruses, malware or harmful code
Collect or track the personal information of others
Send spam, phishing material, unsolicited advertising or promotional messages
Use bots, scraping tools, automated systems, data extraction tools or similar technologies without permission
Interfere with, bypass or attempt to avoid security features or access restrictions

We may restrict, suspend or refuse access to our website where we reasonably believe these Terms have been breached.

3. Accounts and Customer Information

To use certain features of our website, or to place an order, you may be asked to provide information such as your name, email address, billing details, payment details and shipping address.

You confirm that all information you provide is accurate, current and complete, and that you have the right to provide that information.

If you create an account with Dermify, you are responsible for maintaining the confidentiality of your account details and password. You are responsible for all activity that occurs under your account.

You must not transfer, sell, assign or allow another person to use your account without permission.

4. Product Information

We take care to ensure our product descriptions, images, prices and details are accurate and up to date.

Please note that colours may appear slightly different depending on your screen, device settings and lighting. Our natural fibres may have slight variations in texture, finish, colour or appearance. These variations are not considered faults.

To the extent permitted by law, we do not guarantee that the appearance, colour, finish or texture of a product will be identical to how it appears on your device.

Product descriptions, availability and details may be updated at any time without notice. Dermify reserves the right to discontinue any product, limit product quantities, or limit sales to any person, region or location where necessary.

5. Health, Skin and Hair Information

Any information on the Dermify website about hair, skin, sleep or wellbeing is general in nature only.

Dermify does not make any medical, therapeutic or health claims about its products. Our products are not therapeutic goods and are not intended to diagnose, treat, cure, prevent or manage any medical condition, skin condition, scalp condition, hair condition, sleep disorder or health concern.

If you have a medical, skin, scalp, allergy, sensitivity or health concern, please seek advice from a qualified health professional before using our products.

6. Orders

When you place an order with Dermify, you are making an offer to purchase.

After placing an order, you will receive an order confirmation by email. This confirms that we have received your order, but does not guarantee acceptance of the order.

Your order is accepted once payment has been successfully processed and Dermify confirms acceptance or dispatch.

Dermify reserves the right to cancel, refuse or limit an order where necessary, including where:

An item is unavailable
Payment cannot be verified
There is an error in pricing, product information or stock availability
We suspect fraud, misuse or unauthorised activity
Delivery details are incomplete or incorrect
The order appears to be for commercial resale or unauthorised export

If your order is cancelled after payment has been taken, we will provide a refund to the original payment method, unless otherwise required by law.

Please review your order carefully before submitting it, as we may not be able to accommodate cancellation requests once an order has been processed, packed or dispatched.

7. Age and Payment Authorisation

By placing an order with Dermify, you confirm that you are at least 18 years old, or that you have the consent and supervision of a parent or legal guardian.

You also confirm that you are the authorised holder of the payment method used to place the order, or that you have express permission from the authorised payment holder to use that payment method.

Dermify reserves the right to cancel or refuse an order where payment appears to be unauthorised, fraudulent, incorrect or otherwise unable to be verified.

8. Pricing and Payment

All prices are listed in Australian dollars.

Prices, discounts, promotions, products and availability may change at any time without notice.

The price charged for a product will be the price shown at the time the order is placed, as set out in your order confirmation email.

Unless otherwise stated, product prices do not include shipping costs. Shipping costs will be shown at checkout before your order is placed.

Payment must be made in full at checkout. Orders will not be processed until payment has been successfully received.

We use secure third-party payment providers to process payments. Dermify does not store full payment card details.

You agree to provide current, complete and accurate payment and account information. You also confirm that any payment information you provide is true and correct, that you are authorised to use the payment method, and that you will pay all charges incurred at the prices shown at checkout.

9. Promotions and Discount Codes

Promotions, offers and discount codes are subject to their individual terms.

Unless otherwise stated, discount codes:

Cannot be combined with other offers
Cannot be applied after an order has been placed
Cannot be exchanged for cash
Cannot be used on previous orders
May be limited to selected products or time periods

If there is a conflict between these Terms and the terms of a specific promotion, the terms of the promotion will apply to that promotion.

Dermify reserves the right to amend, suspend or cancel a promotion where necessary.

10. Shipping and Delivery

Dermify currently ships within Australia only.

We work to prepare and dispatch your order as soon as possible. Orders are usually processed within 1 to 2 business days, although this may be slightly longer during peak periods, launches, promotions or public holidays.

We offer both Standard Post and Express Post within Australia.

Standard Post: approximately 2 to 8 business days

Express Post: approximately 1 to 3 business days

Delivery timeframes are estimates only and may vary depending on your location, Australia Post delivery schedules, weather events, public holidays or other delays outside of Dermify’s control.

Deliveries to regional or remote areas may take longer than the estimated timeframes above.

To the extent permitted by law, Dermify is not responsible for delays caused by delivery carriers, postal disruptions, weather events, public holidays, customs processes where applicable, or other events outside our control.

11. Signature on Delivery

All Dermify parcels are sent with Signature on Delivery.

If no one is available to sign for your parcel, the carrier may leave a collection card or provide further delivery instructions. Please follow the carrier’s instructions to arrange collection or redelivery.

Once a parcel has been marked as delivered or collected, Dermify is not responsible for lost, stolen or misplaced parcels, except where required by law.

12. Incorrect Shipping Details

Please ensure your shipping details are correct before placing your order.

Dermify is not responsible for delays, failed deliveries or lost parcels caused by incorrect or incomplete addresses provided by the customer.

If you notice an error after placing your order, please contact us as soon as possible at hello@dermify.com.au. We will do our best to assist, but we cannot guarantee changes can be made once an order has been processed or dispatched.

13. Cancellations

If you need to cancel your order, please contact us as soon as possible at hello@dermify.com.au.

We will do our best to assist. However, once an order has been processed, packed or dispatched, we may no longer be able to cancel it.

If your order has already been shipped, you may lodge a return once it has been delivered, provided it meets the conditions outlined in our Returns Policy and these Terms.

14. Returns for Change of Mind

Dermify offers full refunds for eligible change-of-mind returns within 14 days of receiving your order.

Dermify also offers store credit for eligible change-of-mind returns within 21 days of receiving your order.

To be eligible for a change-of-mind return, the item must be:

Unused, unworn, unwashed and unopened
In its original packaging
In a clean, resellable condition
Accompanied by proof of purchase

For hygiene reasons, our products cannot be returned once opened, used, worn, washed or removed from their original packaging, unless they are faulty or otherwise required by law.

Original shipping fees are non-refundable for change-of-mind returns.

Return shipping costs for change-of-mind returns are the responsibility of the customer.

15. Return Approval

All returns must be pre-approved by Dermify in writing before being sent back.

To lodge a return, please contact us at hello@dermify.com.au with your order number and the item you would like to return.

Once approved, your return must be lodged at the post office within the relevant return window.

Items sent back without written approval may not be accepted.

16. Refunds and Store Credits

Once your return has been received and inspected, we will notify you of the outcome.

Approved refunds will be processed to your original payment method. Approved store credits will be issued by email.

Please allow time for your bank or payment provider to process any refund.

Dermify reserves the right to refuse a change-of-mind return if the item does not meet the return conditions outlined in these Terms.

17. Exchanges

Dermify does not currently offer exchanges as a return option.

The best way to secure your preferred piece is to lodge a return for your original order and place a new order separately.

18. Faulty, Damaged or Incorrect Items

If your item arrives faulty, damaged or incorrect, please contact us as soon as possible at hello@dermify.com.au with:

Your order number
A description of the issue
Clear photos of the item and packaging

If your item is confirmed to be faulty, damaged or incorrect, we will provide an appropriate remedy in line with your rights under Australian Consumer Law.

19. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they arrive faulty or fail to be of acceptable quality prematurely.

Our change-of-mind returns policy is separate from your rights under Australian Consumer Law.

20. Product Care and Use

Silk is a delicate textile and must be handled with care.

Dermify is not responsible for damage caused by:

Incorrect washing or drying
Improper storage
Misuse or neglect
Exposure to harsh chemicals, skincare, hair products or fragrance
Normal wear and tear
Failure to follow care instructions

Please refer to the care instructions provided with your item.

21. Intellectual Property

All original content on the Dermify website, including our text, product names, imagery, photography, graphics, branding, logos, icons and original design elements, is owned by Dermify or used with permission.

You must not copy, download, screenshot, save, reproduce, edit, distribute, publish, use or share any Dermify imagery, photography, branding or original content without our prior written permission.

This includes product photos, lifestyle images, website images, social media content, graphics and any visual material created for Dermify.

Any unauthorised use of Dermify content may result in a formal removal request, takedown notice, claim for compensation, or further legal action where appropriate.

Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved by Dermify.

Any third-party fonts, themes, apps, tools or platform elements used on our website remain the property of their respective owners and are used in accordance with their applicable licence terms.

Shopify’s name, logo, product names, service names, designs and slogans are the property of Shopify. All other third-party names, logos, product names, service names, designs and slogans remain the property of their respective owners.

22. Reviews, Comments, Feedback and User Content

If you submit a review, comment, photo, message, idea, suggestion, feedback or other content to Dermify, you confirm that the content is accurate, lawful and your own, or that you have the necessary rights to provide it.

You grant Dermify permission to use, display, reproduce, edit, publish, distribute and share that content for business, marketing, promotional and operational purposes, unless you tell us otherwise in writing.

You must not submit content that is false, misleading, offensive, unlawful, abusive, defamatory, obscene, harmful, or that infringes the rights of another person.

You must not use a false email address, pretend to be someone else, or otherwise mislead Dermify or any third party about the origin of your content.

We may remove or decline to publish content that is offensive, misleading, unlawful, inappropriate, unrelated to our products, or otherwise in breach of these Terms.

These third-party tools and services are provided on an “as available” basis and may be subject to their own terms, conditions and privacy policies.

Dermify does not control all third-party tools or services and is not responsible for their availability, content, accuracy, performance, security or operation.

25. Relationship with Shopify

Dermify is powered by Shopify, which enables us to provide our online store and related services.

However, any sale or purchase made through the Dermify website is made directly between you and Dermify.

By using our website and placing an order, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Dermify, including any injury, damage, loss, claim or issue arising from products purchased from Dermify, except where required by law.

26. Privacy

Your privacy is important to us.

Any personal information collected through our website will be handled in accordance with our Privacy Policy. This may include information required to process orders, arrange delivery, provide customer service, manage returns, send marketing communications and improve our services.

30. Limitation of Liability

This includes, but is not limited to, loss of data, loss of opportunity, loss of profits, website interruptions, delivery delays, or misuse of products.

Nothing in this section limits any rights you may have under Australian Consumer Law.

To the maximum extent permitted by law, you agree to indemnify Dermify, Shopify, and our respective directors, officers, employees, contractors, service providers and affiliates against any loss, damage, claim or expense arising from:

Your violation of any law

32. Termination

Dermify may suspend, restrict or terminate your access to our website, account or services where we reasonably believe you have breached these Terms, misused our website, engaged in fraudulent activity, or acted unlawfully.

Termination does not affect any rights or obligations that arose before termination.

You must not transfer, assign or delegate your rights or obligations under these Terms without Dermify’s prior written consent.

These Terms & Conditions are governed by the laws of Australia.

Any dispute arising in connection with these Terms & Conditions, your use of the Dermify website, or any order placed with Dermify will be dealt with in accordance with the applicable laws of Australia.
